The Supreme Court will on July 2, 2026 deliver a ruling on four pending cases challenging the removal of Her Ladyship Justice Gertrude Torkornoo, after her legal team withdrew an application seeking to review a consolidation order.
In all, five cases were filed at the Supreme Court concerning Justice Torkornoo’s removal. One has since been abandoned and struck out, leaving four cases pending.
Two cases, one issue
This report focuses on two of the four remaining cases. The two suits raised the same legal issues.
In the first case, Justice Torkornoo is listed as a Defendant, together with the Attorney-General. In the second, she is the Plaintiff while the Attorney-General is the Defendant.
Her Ladyship was represented by different lawyers in each case. She filed a statement of her case in one suit but has not filed in the other, more than a year after the case began.
Consolidation and review application
On May 28, 2026, the Supreme Court consolidated the two cases and adjourned for judgment. The Court granted Justice Torkornoo leave to file her outstanding statement of case at any time before judgment is delivered.
On that day, one of Her Ladyship’s lawyers was present in court. The other lawyer sent a letter to the Court seeking to withdraw his services and was not physically present.
On June 23, 2026, the lawyer who had been present on May 28 filed an application asking the Court to review its consolidation order. The grounds: Justice Torkornoo was not given a hearing on May 28 because her other lawyer was not physically in court when the consolidation was made.
A-G opposes, then withdrawal
On Thursday, June 25, 2026, the Attorney-General filed an affidavit in opposition. The A-G argued that the review application was made in bad faith because Justice Torkornoo was duly represented on May 28 and had been given the opportunity to file her statement.
In a new twist, on Friday, June 26, 2026, Justice Torkornoo’s lawyer filed a notice to withdraw the review application.
July 2 date set
The Supreme Court has scheduled Wednesday, July 2, 2026 to resolve all outstanding issues in the four remaining cases concerning Justice Torkornoo’s removal.
The Court’s decision is expected to address the consolidated cases and bring clarity to the legal challenges that have followed the process for her removal from office.
